Terms of Service

Dayrate is built for professional film and video crew and the people who hire them. By creating an account you confirm you are at least 18 and that the information you give us is true.

You are responsible for activity on your account. Tell us at once if you think someone else has access. You may close your account at any time, and closing it deletes your profile and the data attached to it — see the Privacy Policy.

Dayrate is a place to be found and to find people. When you are booked through Dayrate, the agreement is between you and the person or company hiring you — not with us. We are not an employer, a staffing agency, a talent agent, a payroll company, or a party to your contract.

That means we do not set rates, guarantee work, guarantee payment, withhold or pay taxes, provide insurance or workers’ compensation, or supervise how work is done. If you are not paid, or a booking falls through, that is a matter between you and the other party. We may try to help, but we are not liable for it.

Whether you are an employee or an independent contractor of whoever hires you is determined by them and by law, not by Dayrate.

You keep ownership of your profile, credits, portfolio, gear list and anything else you add. You give Dayrate a non-exclusive, worldwide, royalty-free licence to host, display and distribute that content for the purpose of operating the service — including showing your public profile to people who are not signed in, and letting it be shared as a link.

You confirm you have the right to post what you post, including any footage, stills or client names in your portfolio. Remove anything you are not permitted to show.

Credits, experience, rates, union status, gear and vouches are supplied by users. Dayrate does not verify them and does not warrant that any of it is accurate. Match scores and suggestions are automated estimates, not advice, and should not be the only basis for a hiring decision.

A company can record people on a private crew list with a private note. Those notes are visible only to that company’s team, and not to the person described.

If you write these notes, keep them factual and work-related. Do not write anything about a protected characteristic, and do not write anything you could not stand behind. You are responsible for what you write. We may remove notes and may disclose them where the law requires it, including in response to a valid legal request or a data access request from the person concerned.

A rate you have agreed with a particular client is shown only to the two of you. Publicly listed rates are visible to anyone. Neither is a binding offer, and neither obliges you or anyone else to work at that number.

You agree not to:

• copy or scrape the directory, in bulk or otherwise
• impersonate another person or company
• post false credits or vouches, or solicit fake ones
• send unsolicited commercial messages to people you find here
• harass, threaten or discriminate against anyone
• post unlawful, infringing or malicious content
• probe, disrupt or attempt to gain unauthorised access to the service

Dayrate can link to and send messages into services you already use. Those services have their own terms and privacy practices. We are not responsible for them or for what happens to information once it reaches them.

The service is currently free to use. We may introduce paid features in future. If we do, we will give you reasonable notice, and you will never be charged without agreeing first.

You may delete your account at any time. We may suspend or terminate an account that breaches these terms, or where we are required to. Sections 3, 5, 12 and 13 continue to apply afterwards.

Dayrate is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, secure or error-free, or that any match, score or listing is accurate.

To the fullest extent permitted by law, Dayrate and its operators are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost bookings, lost data or lost goodwill, arising out of your use of the service.

Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.

Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

You agree to indemnify and hold harmless Dayrate and its operators from any claim, loss or expense (including reasonable legal fees) arising out of your content, your use of the service, your breach of these terms, or your dealings with another user.

These terms are governed by the laws of the State of California, without regard to conflict of law rules, and the state and federal courts located there have exclusive jurisdiction. If any provision is found unenforceable, the rest continues to apply.

We may update these terms. Each version is dated, and the version you agreed to is recorded on your account. For material changes we will give notice and, where appropriate, ask you to accept the new version before continuing to use the service.
